This page is the full statement of Pogodex’s relationship to the Pokémon and Pokémon GO trademarks and intellectual property. It is the most important legal page on the Site. Please read it carefully.

1. Pogodex is an unofficial fan site

Pogodex is an unofficial fan-made Pokémon GO database and guide resource. Pogodex is not affiliated with, endorsed by, sponsored by, licensed by, approved by, or officially connected in any way to:

  • Niantic, Inc. — the developer and operator of Pokémon GO.
  • Nintendo Co., Ltd. — co-owner of the Pokémon franchise.
  • Game Freak Inc. — co-owner of the Pokémon franchise and developer of the main Pokémon series.
  • Creatures Inc. — co-owner of the Pokémon franchise.
  • The Pokémon Company — the joint venture managing the Pokémon franchise.
  • Any subsidiary, affiliate, or licensee of the above.

References to these companies on Pogodex are editorial: we discuss the game they make, we cite their announcements, we link to their official channels for source verification. None of this constitutes a commercial relationship.

2. Trademarks acknowledged

The following are trademarks of their respective owners and are used on Pogodex only for descriptive (informational) purposes:

  • Pokémon, Pokédex, Pokéball, all Pokémon species names (Pikachu, Charizard, Mewtwo, etc.), all Pokémon visual designs, the Pokémon logo, and the franchise’s distinguishing trade dress are trademarks of Nintendo / Game Freak / Creatures (collectively The Pokémon Company).
  • Pokémon GO, the Pokémon GO logo, the in-game Niantic branding, and the application icon are trademarks of Niantic, Inc. (in some jurisdictions used under license from The Pokémon Company).
  • GO Battle League, GO Fest, Community Day, Spotlight Hour, Mega Raid, and similar event-naming terms are used by Niantic and may have trademark registrations or pending registrations in various jurisdictions.

The list is not exhaustive. Where a term used on Pogodex is a trademark of a third party, the trademark belongs to that third party even where Pogodex does not specifically acknowledge it on every page.

3. Nominative fair use

Pogodex’s use of Pokémon-related trademarks falls within the doctrine of nominative fair use as recognized in U.S. trademark law (Ninth Circuit’s three-factor test in New Kids on the Block v. News America Publishing) and in equivalent doctrines under EU and Italian trademark law:

  • The Pokémon GO product is not readily identifiable without using the Pokémon and Pokémon GO trademarks. We cannot write a counter list for “the legendary fire-type bird raid boss” instead of for Moltres.
  • We use only as much of the trademark as is necessary to identify the product accurately.
  • Pogodex’s use does not falsely suggest sponsorship or endorsement by the trademark holders. The unofficial-fan-site disclaimer appears on the header trust bar, in the footer, on this page, and on the About Us page.

4. Pokémon imagery and visual content

Pogodex’s use of Pokémon visual content is constrained:

  • Promotional artwork from Niantic’s press kit may be used per the standard fan-site permissions, with proper credit. Where used, the rights holder is acknowledged in the article.
  • In-game screenshots are used for editorial illustration under the fair-use / fair-dealing doctrine of the relevant jurisdiction. We use minimum necessary portions for editorial purposes.
  • Original illustrations created in-house carry the Pogodex copyright but do not assert ownership of the underlying Pokémon characters.
  • We do not display unauthorized reproductions of copyrighted Pokémon artwork.
  • We do not generate Pokémon imagery using AI image-generation tools (see AI Usage Policy).

5. What Pogodex does with game data

Numerical game data (base stats, moves, type effectiveness, CP formulas, raid timing) is factual information about the game. Factual information is not protected by copyright. Pogodex republishes such data, accurately and with verification (see Sources & Citations), as part of providing accurate information to readers.

This is the same legal basis on which fan publications about other games operate, and it is not affected by Niantic’s or The Pokémon Company’s intellectual property in the game itself.

6. What Pogodex does not do

To remove ambiguity:

  • We do not provide tools that interact with Niantic’s servers or the live game state.
  • We do not provide GPS-spoofing software, account manipulation tools, or any third-party software that would violate Niantic’s Terms of Service.
  • We do not provide methods for circumventing Niantic’s anti-cheat measures.
  • We do not redistribute Niantic’s source code, game master file, or other Niantic intellectual property as standalone files.
  • We do not present ourselves as Niantic, The Pokémon Company, or any of their affiliates.
  • We do not solicit Niantic account credentials.

7. Respect for Niantic’s Terms of Service

Pogodex’s editorial position respects Niantic’s Pokémon GO Terms of Service. We expect readers to abide by them. We do not facilitate violations. The full position is on our Disclaimer and Terms of Service pages.

8. If you are a rights holder

If you represent Niantic, Nintendo, Game Freak, Creatures, The Pokémon Company, or any affiliate, and you have concerns about specific content on Pogodex, please contact us at info [at] pogodex [punto] space with subject line IP Concern from Rights Holder and we will respond promptly. The DMCA process described on our DMCA page is also available for U.S.-jurisdiction copyright complaints.

We have no current relationship with the rights holders, but we are prepared to work in good faith on legitimate concerns about specific uses of trademarked material.

9. Other game and franchise trademarks

Pogodex occasionally references other Pokémon-franchise products (the main Pokémon games, Pokémon TCG, Pokémon Sleep, Pokémon HOME, Pokémon UNITE) and other gaming products in editorial context. Trademarks belonging to the publishers of those products are acknowledged where used; the same nominative fair-use principle applies.

10. Reader-submitted Pokémon content

Reader-submitted Pokémon-themed art, fan stories, or other creative content is not solicited by Pogodex and, where unsolicited, is not redistributed. Where readers reference their own in-game experiences with Pokémon, those references are factual descriptions of gameplay and are subject to the same fair-use framework.

11. No claim of ownership

Nothing on Pogodex should be read as a claim of ownership over Pokémon or Pokémon GO trademarks or copyrights. The trademarks belong to their owners; Pogodex’s editorial work is its own.
