Terms of Service

These Terms of Service (“Terms”) govern your use of Pogodex (“the Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Identity and capacity
The Site is operated by Giovanni Picaro as the publisher. The Site is an unofficial fan publication and is not affiliated with Niantic Inc., Nintendo, Game Freak, Creatures Inc., or The Pokémon Company. See Trademark Notice for the full statement.
2. Acceptable use
You may access and use the Site for personal, non-commercial purposes consistent with these Terms. You agree not to:
- Reproduce or redistribute editorial content beyond the limits in our Copyright Notice.
- Scrape the Site at a rate that imposes a disproportionate load on the server.
- Use the Site in any way that violates applicable law, infringes another party’s rights, or would cause harm.
- Submit user-generated content that is illegal, defamatory, infringing, or harassing.
- Interfere with the Site’s operation, attempt to access non-public areas, or attempt to circumvent security measures.
- Use the Site to advertise unrelated products or services.
3. Pokémon GO Terms of Service
Pogodex is a third-party fan publication. Your use of Pokémon GO itself is governed by Niantic’s Pokémon GO Terms of Service. Pogodex does not encourage and does not facilitate any practice that would violate Niantic’s Terms, including but not limited to:
- GPS spoofing or any practice that misrepresents your real-world location to the game.
- Use of third-party software that reads game data, intercepts game communications, or automates gameplay (bots).
- Multi-accounting beyond what Niantic’s family-account system permits.
- Account-sharing arrangements.
- Buying, selling, or transferring Pokémon GO accounts.
Where reader email or contributions describe such practices, we do not publish the description, do not provide assistance, and may report serious abuse to Niantic where the abuse harms other players (e.g., raid-pass scams).
4. User-submitted content
Comments, tips, screenshots, and other user-submitted content remain the intellectual property of the contributor. By submitting content to the Site, you grant Pogodex a non-exclusive, royalty-free, worldwide license to display, reproduce, and use the content in connection with the Site, including in articles that incorporate or reference the contribution.
You represent and warrant that you have the right to submit the content, that the content does not infringe any third party’s rights, and that the content does not violate any applicable law. You retain ownership; you can request removal of your contribution at any time, which we will honor where it is not entangled with editorial work that has independently developed (in which case, we will remove the personally identifying part).
5. Intellectual property
Editorial content on the Site (articles, original analysis, original illustrations, the design of the Site itself) is the intellectual property of Pogodex and its respective authors. The Pokémon name, all character names, and all related game assets are the property of their respective rights holders — see Trademark Notice. Use of these trademarks on the Site is descriptive (nominative fair use) for the purpose of accurately discussing the game.

6. Third-party content and links
Articles on the Site link to third-party websites (Niantic’s official channels, PokeMiners, Silph Road, other fan publications). We are not responsible for the content or practices of those third-party sites. Inclusion of a link is not an endorsement.
7. Advertising
The Site displays third-party advertising. The presence of an ad does not constitute endorsement of the advertiser or its products. Our editorial wall (described in Editorial Standards) means that advertising relationships do not influence editorial content. Affiliate links, where present, are disclosed per Affiliate Disclosure.
8. Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” To the extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or harmful components. We do not warrant that recommendations will result in any specific in-game outcome.

9. Limitation of liability
To the maximum extent permitted by applicable law, Pogodex, its publisher, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including but not limited to loss of stardust, loss of in-game progress, loss of raid passes, loss of paid event tickets, or loss of opportunity. Our aggregate liability shall not exceed the greater of (a) one hundred euros (€100), or (b) the total amount you have paid us in the twelve months preceding the claim (which, since the Site is free to read, is typically zero).
10. Indemnification
You agree to indemnify and hold harmless Pogodex and its publisher from any claims, damages, or expenses arising from your violation of these Terms, your user-submitted content, or your violation of any third party’s rights.
11. Termination
We may suspend or terminate your access to the Site for violation of these Terms, for abusive behavior, or for legal compliance reasons. The effect of termination on user-submitted content is described in Section 4.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date reflects the most recent revision. Continued use of the Site after revision constitutes acceptance of the revised Terms. We will not change these Terms in a way that materially reduces your rights without prominent notice.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision shall be reformed to the extent necessary to make it enforceable while preserving its intent.
14. Governing law and jurisdiction
These Terms are governed by the laws of Italy, without regard to conflict-of-law principles. The competent courts of the place of the publisher’s residence have exclusive jurisdiction over disputes arising from these Terms or from use of the Site, except where mandatory consumer-protection law of your country of residence provides otherwise.
15. Entire agreement
These Terms, together with our Privacy Policy, Cookie Policy, Copyright Notice, and other policies referenced herein, constitute the entire agreement between you and Pogodex regarding your use of the Site.
