DMCA Notice & Takedown

Pogodex respects intellectual property rights and complies with the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This page describes how to submit a copyright infringement notice for content allegedly hosted on or linked from the Site, the counter-notice process available to affected users, and our repeat-infringer policy. The same procedure is also accepted from rights holders outside the United States as the operational mechanism for handling copyright complaints, even where DMCA does not directly apply.
1. How to file a DMCA notice
If you are a copyright owner (or authorized agent) and believe content on Pogodex infringes your copyright, you may submit a written notice to our designated agent. The notice must include:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to be infringed (or, if multiple works at a single site, a representative list).
- Identification of the material claimed to be infringing, with sufficient detail (URL or other locator) for us to find it.
- Your contact information: address, telephone number, and email.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
2. Designated agent
The designated agent for receiving DMCA notices is:

We treat email submissions as the standard channel. Postal submissions are also accepted; the postal address is provided on request to dmca [at] pogodex [punto] space.
3. What happens after a notice is received
Upon receipt of a complete notice that meets the DMCA requirements, we will:
- Acknowledge receipt to the complainant within 5 business days.
- Review the notice for completeness and good-faith content.
- Where the notice is valid, remove or disable access to the allegedly infringing material expeditiously.
- Notify the user who posted the material (where applicable) and provide a copy of the notice.
- Inform the user of their right to file a counter-notice.
Where a notice is plainly defective — for example, the work claimed is not subject to copyright, or the use is plainly fair use, or the notice fails the formal requirements — we may decline to act and respond to the complainant explaining why.
4. Counter-notice
If your content has been removed under a DMCA notice and you believe the removal was the result of misidentification or that the use is fair use or otherwise authorized, you may submit a counter-notice. The counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or, for non-U.S. residents, any judicial district where Pogodex’s hosting provider is located), and that you will accept service of process from the original complainant.
Counter-notices should be sent to dmca [at] pogodex [punto] space with the subject line DMCA Counter-Notice.
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action seeking a restraining order against the user within 10–14 business days, we may restore the material at our discretion.
5. Repeat infringers
Pogodex maintains a policy of terminating, in appropriate circumstances, the access of users who are repeat infringers. A “repeat infringer” is a user against whom multiple valid DMCA notices have been filed and substantiated.
6. Misuse of DMCA
Filing a false or bad-faith DMCA notice exposes the filer to liability under 17 U.S.C. § 512(f). We document patterns of misuse and may decline to process notices from filers with a record of bad-faith claims.
7. Pokémon GO content and DMCA
Pogodex publishes commentary, analysis, and factual information about Pokémon GO. Game data (stats, moves, type effectiveness) is factual and not protected by copyright. Original commentary and analysis are protected by copyright (held by Pogodex or its contributors). Niantic’s promotional artwork, when used, is used under the standard fan-site permissions; specific use is subject to fair use analysis under 17 U.S.C. § 107.
