Copyright Notice

This Copyright Notice describes the intellectual property terms governing content on Pogodex. It covers (a) original editorial content created by Pogodex and its contributors, (b) third-party content reproduced or referenced under fair use or with permission, (c) Pokémon-related trademarks and properties owned by other parties, and (d) the express opt-out of AI/ML training described below.

1. Ownership of editorial content

All original editorial content on Pogodex — including articles, original analysis, original illustrations, the Pokédex layout and presentation, the IV calculator and other tools developed in-house, the structure and aggregation of the database, and original photography — is the intellectual property of Pogodex and the respective contributing authors. Copyright is asserted under:

  • The Berne Convention for the Protection of Literary and Artistic Works.
  • Italian copyright law (Legge 22 aprile 1941, n. 633 and subsequent amendments).
  • The U.S. Copyright Act of 1976 (17 U.S.C. § 101 et seq.).
  • The EU Directive 2019/790 on copyright and related rights in the Digital Single Market.

Where original Pogodex content is republished elsewhere, attribution and a link to the original article on pogodex.space are required, even where republication is otherwise permitted.

2. Express opt-out of AI/ML training

Pogodex expressly reserves all rights with respect to the use of editorial content for the training, fine-tuning, evaluation, or other development of artificial intelligence, machine-learning systems, or large language models, including but not limited to:

  • Training data ingestion or use.
  • Retrieval-augmented generation that paraphrases or summarizes editorial content for AI output.
  • Synthetic data generation derived from Pogodex content.
  • Use of Pogodex content as a benchmark or evaluation set.

This opt-out is asserted under:

  • EU Directive 2019/790, Article 4 (text and data mining exception with the right to reserve rights expressly), as transposed into Italian law by D.Lgs. 177/2021.
  • The U.S. Copyright Act, 17 U.S.C. § 106 (exclusive rights of the copyright owner).
  • Italian copyright law L.633/1941 with respect to the moral and economic rights of authors.

Crawling Pogodex for AI training purposes is prohibited regardless of whether the crawl reaches paywalled or login-gated content (which the Site does not have). The robots.txt file declares the same restriction in machine-readable form. We reserve the right to seek injunctive and monetary remedies for unauthorized AI training use.

3. Permitted uses of Pogodex content

Without separate permission, you may:

  • Read and view the Site for personal, non-commercial purposes.
  • Quote brief excerpts (typically up to 200 words from a single article) with attribution and a link back to the source article. This is permitted under the fair-use / fair-dealing / quotation right of the relevant copyright system.
  • Link to articles on Pogodex from any website, including with descriptive anchor text.
  • Print or save articles for personal reference.
  • Reference Pogodex articles in academic work with standard scholarly citation.

4. Uses requiring permission

The following uses require advance written permission from Pogodex:

  • Republication of full or substantial portions of Pogodex articles.
  • Translation and republication.
  • Commercial republication of any kind.
  • Use of original Pogodex illustrations, charts, or tools.
  • Use of Pogodex content in training data for AI/ML systems (see Section 2).
  • Aggregation of Pogodex content into databases or dataset products.
  • Use of Pogodex content in commercial print or digital publications.

Permission requests should be addressed to info [at] pogodex [punto] space with the subject line Permission request and a clear description of the intended use. We respond to legitimate requests within 14 days.

5. Pokémon-related trademarks and copyright

Pokémon, Pokémon GO, the Pokédex, the Pokéball, all Pokémon character names, all Pokémon character designs, the Pokémon GO logo, and all related visual elements are trademarks and copyrights of Niantic Inc. (with respect to Pokémon GO) and Nintendo, Game Freak, and Creatures Inc. (collectively The Pokémon Company, with respect to the Pokémon franchise as a whole).

Pogodex’s use of these trademarks is descriptive (nominative fair use) for the purpose of providing accurate information about the game. The full position is on our Trademark Notice page.

Where Pogodex displays Pokémon imagery:

  • Promotional artwork from Niantic’s press kit is used under the standard fan-site permissions, with rights holders acknowledged.
  • Original illustrations created in-house carry the Pogodex copyright but do not assert ownership of the underlying Pokémon characters.
  • Game screenshots are used for editorial illustration under fair use, with rights holders acknowledged.
  • We do not display copyrighted Pokémon artwork without permission or fair-use justification.

6. Reader-submitted content

By submitting content to Pogodex (comments, tips, screenshots, guest contributions), you grant Pogodex a non-exclusive, royalty-free, worldwide license to display, reproduce, and use the content in connection with the Site, while retaining your own ownership. The full framework is in Section 4 of our Terms of Service.

7. Reporting copyright infringement

If you believe content on Pogodex infringes your copyright, please follow the procedure on our DMCA page.

8. No waiver

Pogodex’s failure to enforce any provision of this Copyright Notice on any particular occasion is not a waiver of the right to enforce the provision generally or in subsequent instances.
